← Land Buyer Report A buyer’s orientation · Thailand

Understand the land.
And the rights you would acquire.

TOMA assesses the land, its price and its fit with your plans. Your own qualified Thai lawyer advises on the ownership or use rights available to you. Together, those findings help inform your purchase decision.

A guide to the roles involved · Updated 1 October 2026 · Not legal advice

Three parts of the decision

The right expertise.
For each question.

Property analysis, verification and personal legal advice each have a role. Knowing who handles what helps you plan the checks your purchase needs.

02 / FURTHER CHECKS

What needs verifying?

The Land Buyer Report includes one observational TOMA visit; additional visits are available at the additional TOMA visit rate. For separate checks of title, encumbrances and legal access, we can introduce you to a qualified third-party lawyer. You agree the scope and fees directly with the provider.

03 / YOUR LEGAL POSITION

Which rights are available to you?

Your own qualified Thai lawyer assesses your personal or corporate eligibility, the proposed arrangement and any approvals it requires.

Advice from your own lawyer · Separate from TOMA

One observational TOMA visit is included in the report; additional visits are available at the additional TOMA visit rate. For title, legal-access, survey and other specialist checks, we can recommend qualified third-party providers, make introductions and help coordinate arrangements. You agree the scope and fees directly with the provider and pay them separately, or use your own professionals. A qualified Thai lawyer advises on your eligibility and ownership arrangements. Our base report does not confirm a legal right to acquire land or permission to build.

Questions for your legal adviser

Advice that reflects
your circumstances.

Your eligibility depends on your circumstances and the proposed transaction. These questions can help you get a clear explanation from your lawyer before paying a deposit or making a binding commitment.

YOUR ELIGIBILITY

Who would hold the right?

Ask your adviser to assess the individual or entity involved, required permissions and any restrictions. For your privacy, share company and shareholding records directly with your lawyer, rather than through TOMA’s enquiry form.

THE RIGHT ITSELF

What would you acquire?

Ask for a clear explanation of the proposed ownership or use right, its conditions, registration, duration and enforceability—including any promised renewal or transfer.

THE TRANSACTION

What must happen first?

Ask which approvals, title and access checks, contract protections and independent advice are needed before a deposit, binding agreement or transfer.

An official reference to discuss with your lawyer.

The Department of Lands publishes procedures concerning land and foreign buyers. Your lawyer can explain which provisions apply to your circumstances; the information on this page is general guidance about our service, not a determination of eligibility.

Our focus

Assessing the property.
A clearly defined role.

TOMA analyses the land within the agreed property scope. We do not assess your private business structure or certify your eligibility to hold land.

We do not establish companies, arrange nominee shareholders or design or assist arrangements that circumvent ownership restrictions. For the authority’s guidance, see the Department of Lands’ nominee-ownership warning (Thai) ↗.

Your report identifies material gaps and warning signs, distinguishing supported findings from questions that need verification. Unresolved questions remain visible; they are not treated as approval to proceed.

Before you commit

Bring the findings
into one decision.

Consider the property and your legal position together, with a clear view of the checks still needed.

  1. Understand your legal position. Ask your own lawyer which lawful rights are available to you and what they mean for the proposed transaction.
  2. Examine the land on its merits. Use TOMA’s analysis to assess the price, constraints, assumptions and case for further investigation.
  3. Complete the relevant checks. Work with the appropriate professionals to resolve legal, site and technical questions before an irreversible commitment.

These separate areas of work inform the same purchase decision. TOMA’s report may recommend further investigation, a pause for verification or a fresh look at the price and assumptions; it does not complete the legal or technical checks itself.
